Alabama Man Sues Abortion Clinic on Behalf of Unborn Fetus

The case will test the rights of the unborn

An Alabama judge has ruled that a 19-year-old will be permitted to sue the abortion clinic that terminated the life of his unborn child.

Ryan Magers, who says his ex-girlfriend had an abortion against his wishes, filed a lawsuit against the Women's Center for Reproductive Alternatives in Madison Country, local CBS affiliate WHNT News 19 reported Tuesday.

According to the woman's father, his family was "really distraught", adding that she was aged 16 years at the time and Mr. Magers was unemployed whilst discovering she was pregnant.

Madison County probate court Judge Frank Barger even allowed Magers to name his aborted child as a co-plaintiff in his case.

Mat Staver, founder and chairman of the conservative legal group Liberty Counsel, said the judge's decision to allow "Baby Roe" in court is a huge legal triumph for the pro-life movement.

Magers is demanding a jury trial.

Magers' attorney, Brent Helms, added that the legal victory was "the first one of its kind, ever".

"I'm here for the men who actually want to have their baby", he said.

Magers was pleased with the ruling and how significant for himself and future fathers.

Personhood Alabama spokeswoman Hannah Ford told LifeSiteNews with the recent abortion debates after NY and other states have pushed for lifting restrictions on abortions, this case is a "timely reminder that every single abortion committed is a chilling assault on a precious and innocent human life - an intolerable violation of the most basic, God-given human right, the right to life".

"Under Alabama law, an unborn child is a legal person, ' the complaint reads".

Dalton Johnson, owner and administrator of the Alabama Women's Center, said the case is "unprecedented, and we are assembling our legal team".

"This case also highlights the rights of a father, because a father should generally share some parental rights with a mother when children are concerned", Klukowski observed. It asserts that a woman's rights are "third in line", after the rights of a man who impregnates her and the fetus she aborts, she said.

"Just one month after Justice Kavanaugh took his seat on the bench, voters in Alabama and West Virginia approved state constitutional amendments meant to allow for additional abortion restrictions or even pave the way for outright bans on abortion in the event Roe is undermined or overturned", the report said.

"[Roe's mother] is one voice among three in this scenario", Ilyse Hogue, NARAL's president tweeted yesterday.

Abortion advocates in the state say they don't expect the suit to ultimately prevail, but admitted to disbelief that it's made it as far as it has.

The lawsuit's defendants include the abortion clinic, staff members and a drug maker that manufactured the drug used in the abortion, according to the court filing.
