Judge Rules Harvey Weinstein Must Face Remaining Rape Charges

Harvey Weinstein, the disgraced former movie mogul, continues to face charges of rape and sexual assault in NY state, after his legal team failed in its bid to have the case thrown out.

He is accused of raping a woman in a hotel room in March 2013 and forcibly performing oral sex on another woman in 2006 at his apartment in Manhattan.

Weinstein's attorney Benjamin Brafman told reporters after the hearing, "Mr. Weinstein has denied these crimes".

Some even suggest that prosecutors will eventually cave, as they did in dismissing sex assault charges brought against former International Monetary Fund chief Dominique Strauss-Kahn - also defended by Brafman - in 2011.

After the private conversation, Burke adjourned the hearing by only saying, "I will see you again March 7 for pretrial hearings". Another option is that the judge could throw the indictment out - but give prosecutors time to seek a new one.

Prosectors will likely look to obtain testimony from additional women who have accused Weinstein of sexual assault, says Bennett Gershman, a Pace Law professor and a former prosecutor with the Manhattan District Attorney's Office. His lawyers had claimed that the case was tainted by police and prosecutorial misconduct. However, prosecutors argued there's ample evidence to move forward to trial and Burke agreed.

The case has been mired in complications, with Weinstein's team alleging police misconduct in the investigation.

DiGaudio allegedly told the witness in February that when she spoke to prosecutors, "less is more". "If these women testify strongly on the witness stand, Weinstein will lose".

The friend told investigators that Weinstein and the accuser had been "hooking up" consensually for a while and that she never heard her say anything bad about him until previous year, Brafman said in a court filing.

They have said the prosecutors' case is tarnished by police misconduct and asked for an evidentiary hearing over the revelations.

They say everything in Haleyi's mobile phone was turned over to investigators, and that the detective's conduct only affected Evans' case. Weinstein's lawyers are also claiming that the prosecution has not included evidence, specifically correspondence between Weinstein and his accusers that they claim allude to a consensual relationship.

One of the six felony charges Weinstein faces was thrown out following an error by a detective investigating the case, prosecutors said.
