James Comey files case against House Republicans to stop subpoena

Comey is challenging a House of Representatives subpoena that would require him to answer further questions about his involvement in the Hillary Clinton email scandal and his handling of Russia's potential meddling with the 2016 general election.

It is outrageous for somebody who says they want transparency, that he wants to testify before in an open hearing, that he is now trying to squash this subpoena.

In Thursday's filing, his lawyers argue that the House Judiciary and Oversight committees "have conducted an investigation in a manner that exceeds a proper legislative goal insofar as members of the committees have established a practice of selectively leaking witnesses' testimony in order to support a false political narrative, while subjecting witnesses to a variety of abuse". Lynch was subpoenaed to answer questions in a closed-door session on Tuesday, the day after Comey.

Comey's lawyers cited a Supreme Court ruling born from the Joseph McCarthy Red Scare hearings in the 1950s and argued that the "abusive conduct" of the House investigation is in violation of Congress' own rules and done to "harass and intimidate witnesses". Attorneys for the former Federal Bureau of Investigation director told the court that the subpoena "exceeds a proper legislative goal, is issued in violation of House rules, and unduly prejudices and harasses the witness", according to the court documents (pdf). He needs to appear before the Committees, as all other witnesses have done.

Comey's legal team argues that the request for a closed-door testimony "exceeds a proper legislative objective, is issued in violation of House rules, and unduly prejudices and harasses the witness".

Both Republican lawmakers overseeing the congressional investigation - Judiciary Chairman Bob Goodlatte and Oversight Chairman Trey Gowdy - did not run for re-election and will be leaving Congress at the end of the year. "But I will resist a "closed door" thing because I've seen enough of their selective leaking and distortion".

According to The New York Times, Trump wanted to order the Department of Justice to investigate Comey and Clinton, but the white house counsel repelled his decision out of worries that it would potentially create political clashes. However, Comey is willing to make a testimony in public. He was subpoenaed to appear next week.
