Supreme Court nomination has become a campaign issue

Trump: I 'probably won't' ask Supreme Court nominees about Roe v. Wade

President Donald Trump is in the process of picking a replacement for outgoing Supreme Court Justice Anthony Kennedy, and at least two MI judges are being closely considered.

Speaking to reporters at the White House, Trump said he had met with "four potential justices of our great Supreme Court". He has often served as a swing vote between the court's liberal and conservative justices. He said he found it "distracting" to his work in 2016 when he found himself on Trump's short list of nominees to replace Scalia, a job that eventually went to Justice Neil Gorsuch.

Hume said if Trump loses the support of Collins and Murkowski "it's hard to believe" the Republicans would "pick up any Democrats" to achieve a majority confirming the nominee. They hope to convince Collins and Republican Sen.

His republican opponent, Corey Stewart, has called on the president to nominate someone who will "move the court further in a conservative direction that respects the Constitution and our freedoms".

Republican Senator Susan Collins is being sent coat hangers in the mail by abortion rights activists keen to encourage her to vote down any Supreme Court nominees who would threaten Roe v. Wade.

Former Justice Department official Tom Dupree said Murkowski's decisionmaking should be handled "delicately" because she is one of the only senators to ever win a seat through a "write-in campaign" rather than being printed on the ballot. On Monday, Senate Minority Leader Charles Schumer, D-N.Y. criticized the record of U.S. Appeals Court Judge Amy Coney Barrett of IN, who is one of seven judges considered to be front-runners. Even though Senate Majority Leader Mitch McConnell changed Senate rules past year to allow confirmation by simple majority, if Democrats hold together, he can not afford defections.

"There are not a lot of nominees on that list that many Democrats will support", said Tobias, noting that any candidate backed by the Federalist Society is likely comfortable overturning Roe v. Wade. "Those are people who are under very serious consideration, two of them as you know are people who throw the process to some extent", Leo said. A senior White House official said that Trump did not conduct any interviews with potential Supreme Court picks over the weekend. That judicial approach typically involves a more literal interpretation of the Constitution as compared to broader rulings such as Roe.

"I had a very, very interesting morning", Trump said on Monday, according to the Post, which reported that he described the candidates as "outstanding people", but did not name them.

NARAL Pro-choice America has purchased ads targeting Sen. Collins said she would back only nominees who would show respect for settled law such as the Roe decision. Vice President Mike Pence can break a tie.
