Florida retailers cheer Supreme Court online sales tax decision

The Supreme Court on Thursday ruled that states can collect sales tax from all retailers, even if those retailers do not have a "physical presence" in their state - ultimately paving the way for states to collect sales tax from online retailers.

State officials - including in SC, with its 6 percent sales tax - have argued they were losing out on millions - if not, in some cases, billions - of dollars in revenue a year under the Supreme Court's previous 1992 decision.

Shares of Amazon and other online retailers fell Thursday morning after the Supreme Court ruled that individual states can require tax collection on digital sales.

For years, brick-and-mortar chains have complained of an uneven battlefield in the e-commerce wars, saying they had to charge and collect sales taxes everywhere while e-commerce rivals did not, except in states where they had a physical presence such as a distribution center or a store.

The ruling opens the door to a new revenue stream to fill state coffers - up to $13 billion annually, according to a federal report - while imperiling a competitive advantage that e-commerce companies had over brick-and-mortar rivals that already must collect sales tax.

The majority justified the decision partly because, as online commerce has grown, these precedents now unfairly punish companies who are based within a state when compared to those who are situated elsewhere. Now, some companies had, like Amazon had been remitting the sales tax to us already on internet sales.

You have most likely been able to avoid paying sales tax on a lot of online purchases over the years, but that's coming to an end. "Issues regarding smaller mom-and-pop retailers, and the amount of sales necessary to impose the collection obligation on them, would be decided on a case-by-case basis", he said. But, if a business did not have a physical location in a state, it nearly certainly did not charge sales tax in that particular states.

For as long as internet shopping has been around, the issue of sales tax has been a hot-button issue.

Only five states do not have a state-wide sales tax: Alaska, Delaware, Montana, New Hampshire, and Oregon. Residents are now obligated to pay a use tax on out-of-state online purchases. Today, the retail giant collects taxes in every state that has a sales tax.

"At this time, the Department is reviewing the ruling and its impact on Florida sales tax", a Revenue spokeswoman said.

The slight negative is in regards to Amazon's third-party sellers.

More than 40 states had submitted testimony in favor of upholding the South Dakota law.
