Parents sue 30-year-old son to evict him from their house

Then, he ordered that Rotondo be evicted anyway, according to the Post-Standard. They gave him 14 days to vacate, saying he "will not be allowed to return".

Mark and Christina Rotondo brought the case to court in upstate NY after their son ignored several eviction letters offering money and other help.

"Michael, here is $1,100 from us to you so you can find a place to stay", a February 18 letter his parents left him reads, "There are jobs available even for those with a poor work history like you".

"You only have one mom and dad, and I understand that you are probably more upset than you're letting on, but don't you want to reconcile with them?"

Christina and Mark Rotondo made the decision to sue their son - who moved back in with them eight years ago - after he ignored repeated formal letters they wrote asking he move out.

During the hearing on Tuesday, Michael represented himself and cited the case of Kosa v. Legg: "that there is 'Common law requirement of six-month notice to quit before tenant may be removed through ejectment action". "I really just want to get out of the situation", he said. Rotondo maintained that what Greenwood was doing was wrong.

The parents filed an official eviction petition on May 7. There, he answered their questions, telling them he occupies a bedroom in his parents' home, doesn't speak to them and isn't ready to leave home.

His parents declined to discuss the case with reporters at the courthouse and could not be reached for comment.

The notes escalated into a formally worded notice for Rotondo to leave that set a 30-day deadline - which lapsed on March 15.

"After a while it just kind of beats itself down to where there's nothing left", he said. Rotondo is calling his parent's effort "retaliatory". Rotondo noted that microphones placed by the media were on the lawyer's podium.

The judge agreed and granted the eviction.

In court, Rotondo noted that his parents did not support him by providing food or doing his laundry. Greenwood, who appeared exasperated, suggested the man use Airbnb to find a place to stay on such short notice.

Michael called the judgment "outrageous" and indicated that he intends to appeal.

They later tried to offer their son money to move out.
